In these terms and Conditions “ITA” means Ireland Tattoo Academy and the “Client” means the person firm or company for whom ITA is providing the services.
The contract between ITA and the Client shall be concluded upon the issue by ITA of a booking confirmation and ITA’s booking confirmation will be deemed to bind the Client to these terms and conditions. No services shall be performed by ITA except in accordance herewith. In the case of any conflict between these conditions and those of the Client, these conditions will prevail.
No other agreement, representation, promise, undertaking or understanding of any kind unless expressly confirmed in writing by an authorised representative of ITA shall add, vary or waive any of these Conditions.
1. Definitions
In this Agreement the following expressions shall have the following meanings: –
“Course” – the training course set out in ITA’s confirmation letter together with any other services which may be agreed upon by the parties from time to time.
“Fee” – means the sum to be charged by ITA for the provision of the Course as advised by ITA at the time of booking or as set out in ITA’s booking confirmation whichever is the later.
“Force Majeure” – means, in relation to either party, any circumstances beyond the reasonable control of that party (including, without limitation, any act of God, fire, act of government or state, war, civil commotion, insurrection, strike, lock-out or other form of industrial action).
2. Provision of the Course
2.1 ITA shall allocate sufficient resources in order to provide the Course to the Client and shall, at all times, carry out the provision of the Course with reasonable care and skill.
2.2 Provision of the Course by ITA shall, as far as ITA is able, be in accordance with any dates and times specified in ITA’s confirmation letter but time for performance shall not be of the essence of the contract and ITA reserves the right to alter the date, time or venue. ITA shall not be liable for any delays howsoever caused.
2.3 All Courses must be booked in advance and students must present ITA’s booking confirmation upon commencement of the Course.
2.4 ITA reserves the right to cancel a Course or terminate a student’s participation from a Course in the event that:

2.4.2 the student is late attending the Course; or

2.4.3 the student does not participate satisfactorily in the Course; or
-
2.4.4 by reason of the student’s conduct ITA believes that the student is not capable of satisfactorily completing the Course; or

2.4.5 the student’s behaviour is abusive or unreasonable or the student uses bad or unacceptable language.
2.5 If ITA exercises its rights to cancel a Course pursuant to clause 2.4 before commencement of the Course, then a full refund of the Fee paid by the Client shall be made. However, if ITA exercises its rights to terminate a student’s participation in a Course once the Course has commenced then no refund of the Fee shall be made.
2.6 Upon successful completion of the Course ITA will issue the student with a certificate of achievement, which shall be sent to the Client by post. ITA shall not be liable for the non-delivery of any certificate and in the event that the Client requires a replacement or amended certificate, ITA shall be entitled to charge a fee. The applicable fee will be notified upon request.
3. Fee
3.1 In consideration of ITA providing the Course to the Client, the Client shall pay to ITA the Fee. The Fee is payable immediately upon the Client booking the course and, subject to clause 8.3, is non-refundable.
3.2 In the event that ITA agrees to accept a deposit rather than the full Fee upon booking, the deposit is non-refundable. The balance of the Fee is payable no later than 7 days before the Course commences.
3.3 In addition to the amount payable, the Client shall, on provision by ITA of a valid tax invoice, pay any Value Added Tax properly payable on the Fee.
3.4 If the Client fails to make payments in accordance with Clause 3, ITA shall be entitled—without prejudice to any other rights—to suspend provision of the Course (in whole or in part) until payment is made in full.
3.5 If ITA has to chase payment of any outstanding sums, it shall be entitled to charge an administration fee of £75.00. ITA may choose to waive this fee.
3.6 If ITA agrees to issue a refund of the Fee (or part of it), an administration fee of £75.00 may be charged. ITA may choose to waive this fee.
4. Confidential Information, Engagement of Employees and E-mail Communications
4.1 Both parties agree to treat any proprietary or confidential information disclosed during the Course or its preparation as strictly confidential unless otherwise required by law or agreed in writing.
4.2 These confidentiality obligations shall not apply to information that:

4.2.1 is already public;

4.2.2 is received from a third party with lawful rights to disclose it; or
-
4.2.3 must be disclosed under applicable law.
4.3 Each party agrees to safeguard all records of the other and acknowledges that such records remain the property of the disclosing party.
4.4 Neither party may employ or contract with any staff member or consultant of the other for 12 months after termination of this Agreement.
5. Intellectual Property
5.1 All intellectual property rights in any training materials, course notes or documents developed by ITA are the sole property of ITA. The Client may not reproduce or distribute them under any circumstances.
6. Warranties and Limitation of Liability
6.1 ITA will deliver the Course with reasonable care, skill, and timeliness.
6.2 ITA will not be liable for any indirect or consequential loss, including loss of profit or business. However, ITA does not limit liability for death or personal injury caused by its negligence.
6.3 ITA’s total liability to the Client is limited to the total Fee paid.
6.4 Completion of a Course does not guarantee employment or recognition outside the United Kingdom.
7. Status
7.1 ITA and the Client agree that their relationship is one of independent contractor and client. Nothing in this Agreement creates a partnership, agency, or employment relationship.
8. Terms, Rescheduling, Substituting Students and Cancellation
8.1 This Agreement comes into force upon confirmation by ITA and remains in place until the Course is completed or terminated as per these terms.
8.2 ITA may reschedule a Course by giving at least 4 days’ notice via email or phone.
8.3 Bookings made on weekends or bank holidays will be processed the next working day. Confirmation will be sent once offices reopen.
8.4 Under the Consumer Contracts Regulations 2013, a Client who is a consumer may cancel within 14 days of booking by providing written notice.
8.5 To cancel a Course outside the 14-day cooling-off period, the Client must give at least 10 days’ notice. No refund will be given for non-attendance.
8.6 Once the Course has commenced, if the student chooses to discontinue participation for any reason, no refund of the Fee shall be provided. Requests to reschedule after the Course has started will be entirely at the discretion of ITA and subject to availability. ITA is under no obligation to offer an alternative date once the Course has commenced.
8.7 If the Client wishes to reschedule before the Course begins, at least 10 working days’ written notice is required. ITA will attempt to accommodate this at no extra cost, but rescheduling is not guaranteed, and only one date change is permitted.
8.8 Student substitutions are permitted with at least 7 days’ written notice.
9. Force Majeure
9.1 If a party is unable to perform obligations due to force majeure, they must notify the other party in writing. They will be excused from performance for the duration of the force majeure event.
10. Notices
10.1 All notices must be sent by registered or recorded post to the party’s address as stated unless otherwise notified.
10.2 All communications must be in English unless otherwise agreed.
11. Product Sales & Returns
11.1 Please allow up to 2 working days for processing. Items are sent via 2nd class Royal Mail unless otherwise requested. Tracking is not included by default.
11.2 Next-day delivery requires orders before 1:00 PM and excludes weekends. ITA reserves the right to use alternative delivery methods if delays are expected.
11.3 Returns must be made within 14 days in original, unopened condition. Partial returns are not accepted.
11.4 No refunds will be issued for used items. Return postage is the responsibility of the buyer.
12. Free Kits and Referrals
12.1 Free Tattoo Kits were promotional and only intended for practice skin. As of 01/05/2023, this offer has ended.
12.2 Free Piercing Kits are promotional. One set of three mini kits is provided when in stock and dispatched within 14 working days after course completion. All jewellery must be sterilised before use.
12.3 Referrals are for the benefit of students. If earnings are referenced (e.g. £120), this is based on an average of £40 per piercing and may vary by location.
13. Accreditations
13.1 Courses are CPD accredited. Accreditation is not legally required in Ireland but reflects ITA’s training standards. ITA may hold one or more accreditations at any time.
14. Models, Free Tattoos and Piercings
14.1 Piercing models must book via the ITA website. Models receive free jewellery and piercing performed by a student under supervision.
14.2 Tattoo models must submit a design for approval. All tattoos are done by trainees, and models accept this by submitting their design.
Students are advised to arrange models during the first week. If they cannot secure one, they must inform course administrators. Students may tattoo themselves or peers with consent.
